Indiana House Insurance Committee Amends and Approves Legislation Defining Deceptive Collision Repair Practices

Adds language to Senate Bill prohibiting assignment of benefits to collision repair facilities. Amendment eliminates most restrictions on insurers.

The Indiana House Committee on Insurance amended and approved Senate Bill 164 (SB 164) on February 21 by a vote of 12-0. While SB 164 originally included extensive anti-steering provisions, amendments in both the Senate and now the House have expanded restrictions on collision repair shop activities while eliminating proposed restrictions from auto insurance companies.

In addition to the bill’s proposed restrictions on collision repair facilities prohibiting intimidating insureds from using an insurer’s drive-in claim center or deny access to vehicle

    The Insurance committee removed the unfair and deceptive acts and practices for insurers but made it unfair and deceptive for repairs to inform consumers and take assignment of claim. No more direction to pay authorizations.

    It doesn’t take a rocket scientist to see who is buttering the bread of thr insurance committee. Looks like insurers have moved up in the world from buying judges to buying the legislature.

    Good luck to the poor consumers and repairers in this state. Be a good idea to keep track of these insurance committee members so they can be named conspirators in a wrongful death law suit in the future. Also track the insurance lobbyist and their donations to these legislators.
